Welcome to DuskTrailStation ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at dusktrailstation.xyz (the "Service") operated by DuskTrailStation.
By reserving a charter or using our Service, you consent to these Terms. If you do not agree with any part of the terms, you should refrain from using the Service.
2. Service Overview
DuskTrailStation offers high-end yacht charter services, which include but are not restricted to:
- Day-to-day yacht hire
- Evening cruises
- Business retreats
- Exclusive gatherings
- Long-duration charters
All offerings are subject to both availability and climatic conditions. We retain the ability to alter or cease services whenever necessary.
3. Booking and Reservations
3.1 Booking Process
When you wish to book a charter, you are required to:
- Be at least 18 years old
- Submit accurate and comprehensive information
- Make the necessary deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is only regarded as confirmed after the necessary payment is made and our written confirmation is issued. We maintain the right to decline service to any person at our own discretion.
3.3 Availability
Charter availability is contingent upon vessel readiness and suitable weather conditions. Reasonable efforts will be exerted to accommodate your chosen dates and hours.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and cover any applicable taxes unless stated otherwise. Prices may shift and are subject to prior changes without notice.
4.2 Payment Schedule
- Initial deposit: Half of the overall charter cost required at the time of booking
- Remaining balance: Must be paid 48 hours before the scheduled departure of the charter
- Other fees (if applicable): Payable upon completion of the charter
4.3 Payment Methods
We accept most major credit cards, direct bank transactions, and authenticated cheques. Our payment processes are carried out via secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: Full refund minus processing costs
- Between 24 to 72 hours notice before departure: Half of the amount is refundable
- Fewer than 24 hours notice before departure: No refund is provided
5.2 Weather Cancellations
In the event the captain deems the weather unsafe, the options are:
- Rescheduling the charter to a subsequent available date at no extra charge
- Providing a complete refund if rescheduling is not feasible
5.3 Mechanical Issues
If there's a mechanical fault with the vessel you've been assigned, we will strive to present an appropriate alternative. Should there be no alternative vessels available, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Heed all instructions from the crew
- Utilize safety gear when it’s required
- Disclose any medical conditions that might compromise their safety
- Stay in designated parts of the vessel
6.2 Prohibited Items
The items below are prohibited aboard:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Beverages beyond reasonable consumption
- Pets, except with prior approval
6.3 Conduct
Passengers are required to behave respectfully. We retain the right to end any charter prematurely and without a refund if the conduct of any passenger poses a threat to safety or spoils the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the amount paid for your charter. We hold no responsibility for:
- Injuries sustained due to passenger carelessness
- Theft or damage to personal items
- Secondary, consequential, or punitive damages
- Delays due to weather or other external factors beyond our control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained by us that covers our vessels and operations. It is the responsibility of passengers to secure their travel and personal insurance.
7.3 Assumption of Risk
By making use of our charter services, you comprehend that maritime activities come with inherent dangers and you accept responsibility for your personal safety and well-being.
8. Modifications and Itinerary Changes
Adjustments to itineraries, paths, or timetables may be made due to weather, safety, or operational needs. We will endeavour to ensure comparable experiences where alternatives are necessary.
9. Force Majeure
We shall not be held liable for any delays, cancellations, or changes that arise from conditions not within our control, which include but are not limited to:
- Extreme weather conditions
- Natural disasters
- Regulatory measures
- Closures of ports
- Equipment failures
10. Privacy and Data Protection
We manage your personal information following our Privacy Policy. Engagement with our services implies consent to the gathering and use of your data as specified in our Privacy Policy.
11. Intellectual Property
